자유, 평등, 정의 서울중앙지방법원 서울中央地方法院 👨⚖️법원이란 무엇인가?👨⚖️ 법원의 사전적 정의를 따르자면 사법권을 행사하는 국가 기관으로 등재되어있습니다. 👨⚖️법원이 하는일은 무엇인가?👨⚖️ - 법에 따라 옳고 그름을 따져 사람들 사이에서 생긴 갈등을 해결해 줍니다. - 개인이나 국가로부터 피해를 입은 사람을 도와줍니다. - 사회에 피해를 준 사람에게는 벌을 주어 사회 질서가 유지되도록 합니다. 👨⚖️공정한 재판을 하기 위한 노력👨⚖️ ① 사법권의 독립 - 법관이 헌법과 법률에 의해 양심에 따라 독립하여 심판하도록 하고 있습니다. - 재판에 관해서 국회, 정부의 간섭을 받지 않습니다. ② 3심 제도 : 한 사건에 대하여 세 번까지재판을 받을 수 있는 제도를 마련하고 있습니다. - 목적 : 만약 재판이 한 번만으로 끝난다면 억울한 일이 생길 수도 있기 때문에 이를 막기 위한 방안입니다. - 과정 : 두 번의 재판 결과에도 따를 수 없을 때에는 우리나라 최고 법원인 대법원에서 재판을 받게 됩니다. ※ 우리나라의 심급 제도※ ① 원칙 : 우리나라는 원칙적으로 3심제를 채택하고 있습니다.. ② 예외 - 선거 재판의 경우 기초 자치 단체장 선거는 2심제, 광역 자치 단체장과 국회 의원, 대통령 선거는 단심제입니다. - 특허 재판은 2심제, 헌법 재판은 단심제입니다.
