公安机关是国家治安行政机关 中国的公安机关是国务院和各级人民政府领导下的行政职能部门，是国家行政机关的重要组成部分。但公安机关不同于普通的行政机关，它是掌管社会治安，行使国家治安管理权的专门机关。治安管理是国家行政管理一个十分重要的方面，其范围非常广泛，涉及国家生活的各个方面以及社会生活的各个领域和社会的各个阶层；其作用极其重要，涉及社会秩序、国家安全、人民民主专政政权的巩固和社会主义建设事业顺利进行的大局。与此相适应，国家赋予公安机关以不同于普通行政机关的各种强制手段，以完成公安机关所担负的治安管理的职能，同时也使公安机关成为国家其他行政管理活动的坚强后盾。
