제28조(시·도경찰청장) ① 시ㆍ도경찰청에 시ㆍ도경찰청장을 두며, 시ㆍ도경찰청장은 치안정감ㆍ치안감(治安監) 또는 경무관(警務官)으로 보한다. ③ 시ㆍ도경찰청장은 국가경찰사무에 대해서는 경찰청장의 지휘ㆍ감독을, 자치경찰사무에 대해서는 시ㆍ도자치경찰위원회의 지휘ㆍ감독을 받아 관할구역의 소관 사무를 관장하고 소속 공무원 및 소속 경찰기관의 장을 지휘ㆍ감독한다. 다만, 수사에 관한 사무에 대해서는 국가수사본부장의 지휘ㆍ감독을 받아 관할구역의 소관 사무를 관장하고 소속 공무원 및 소속 경찰기관의 장을 지휘ㆍ감독한다. ④ 제3항 본문의 경우 시ㆍ도자치경찰위원회는 자치경찰사무에 대해 심의ㆍ의결을 통하여 시ㆍ도경찰청장을 지휘ㆍ감독한다. 다만, 시ㆍ도자치경찰위원회가 심의ㆍ의결할 시간적 여유가 없거나 심의ㆍ의결이 곤란한 경우 대통령령으로 정하는 바에 따라 시ㆍ도자치경찰위원회의 지휘ㆍ감독권을 시ㆍ도경찰청장에게 위임한 것으로 본다. 부칙 제5조(지방경찰청 등에 관한 경과조치)
